Mix Theory Studios' Monthly Lottery Giveaway

No purchase is necessary to enter or win.  Purchase will not increase your chances of winning.  All Federal, State, Local and Municipal laws and regulations apply. Void where prohibited.  Prizes are non transferable and are not for resale.  Combined prize fair market values do not exceed $600.

1. ELIGIBILITY:  

Mix Theory Studios’ Monthly Lottery  Giveaway (the “Sweepstakes”).  Entrants must be at least 18 years old and a U.S. Florida Resident to participate.  The Sweepstakes is subject to federal, state, local and municipal laws and regulations.  Limit one (1) electronic entry per month per entrant.

2. SWEEPSTAKES SPONSORS: 

The Sweepstakes is sponsored solely by Mix Theory Studios, Inc., located at 233 E. Bay Street, Suite 610, Jacksonville, FL 32202.  This giveaway is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, or LinkedIn (“Social Media Platforms”).

3. AGREEMENT TO OFFICIAL RULES: 

Participation in the Sweepstakes constitutes entrants’ full acceptance and unconditional agreement to the terms and conditions set forth in these Official Records.  Decisions made by Sponsors are final and binding.  Randomly selected winners will forfeit their prize if not compliant with the terms and conditions set forth within.

4. SWEEPSTAKES ENTRANCE: 

The monthly Sweepstakes will run from 12:01 am EST on the first of every month through 11:59 pm on the last day of that month. Random selections will occur and be posted to Mix Theory Studios’ Instagram account by the fifteenth day of the following month.  Monthly winners will be notified via email.  

5. HOW TO ENTER:

An entry must be submitted electronically with a valid email account at https://mixtheorystudios.com/forms/.  Accepted entries will see “Thank you for answering our survey.  Your submission was received.” after the submission was successfully sent.  Entrants will be disqualified for submitting more than one entry per email per month or for not providing a valid email address.  Your submission will be electronically submitted with the date and time of your submission to us through ClickUp.  By submitting an entry, you also agree to the terms and conditions of ClickUp’s privacy policy.  

6. PRIZE DRAWINGS: 

Each monthly winner will receive a $100 Mix Theory Studios’ voucher to be used for recording or production services at Sponsor’s downtown Jacksonville Florida studio.  Mix Theory Studios will randomly select and announce the monthly lottery winner via its Instagram account by the sixteenth day of the following month and in its monthly newsletter.  Winning entries are non transferable. By entering, participants validate that they are able to claim and participate in the available prize to include, but not limited to, willingness to travel to the downtown Jacksonville location. All prizes are provided by Sponsor.  Sponsor does not make any stated warranties, guarantees, or other representations related to prizes. 

7. WINNER NOTIFICATIONS: 

A valid email is necessary to be selected and contacted upon selection. The Sponsor will make all efforts necessary to contact winners using the indicated contact information (as outlined above).  If Sponsor is unable to reach or have verified communications with the winner, the winning entry is subject to forfeiture. Each winner will have fifteen (15) days of notification to claim their prize.  If the winner does not respond or does not comply with these Official Rules, the winning entry will be subject to forfeiture.  

8. GENERAL CONDITIONS: 

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Sweepstakes is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

9. RELEASE AND LIMITATIONS OF LIABILITIES: 

By entering the Sweepstakes, entrants agree to release and hold harmless the Sponsor, its employees, representatives, agents, shareholders and any other affiliates associated with the Sweepstakes (the Released Parties) from and against any claim or any action arising out of participation in the Sweepstakes or receipt or use of the prize (or any travel or related activity thereto).  Released Parties are not responsible for any lost entries, electronic, hardware, internet or other computer/communications related malfunctions, giveaway disruptions, injuries, losses or damages caused by events beyond the control of Sponsor, any printing or typographical errors in any materials associated with the giveaway.  Sweepstakes entrants release Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the giveaway or delivery, mis-delivery or acceptance of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Released Parties are also not responsible for inaccurate or incomplete information.  Entrants waive the right to claim any damages, whatsoever, including but not limited to punitive, consequential, direct or indirect damages.

10. DISPUTES: 

Except where prohibited, each entrant agrees that any disputes, claims and causes of action arising out of, or connected with the Sweepstakes or any prize awarded, shall be resolved individually, without resort to any form of class action and exclusively by the appropriate court located in Florida.   All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Florida, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Florida.

11. PRIVACY:

Information collected from entrants is subject to Sponsor’s privacy policy and ClickUp’s privacy policy.  Sponsor does not sell personal information or data.  All monthly entries will be destroyed after the monthly winner is identified, contacted and confirmed.

By electronically submitting an entry to the Mix Theory Studios’ Monthly Lottery, the entrant is acknowledging and agreeing to this Release and Declaration of Compliance Waiver:

 

(a) I acknowledge that I have read, have complied and will comply with all rules, regulations, terms and conditions set forth in the Official Rules (contained herein), that I have not perpetrated and will not perpetrate any fraud or deception in connection with the Sweepstakes and have not sought to influence the outcome of the Sweepstakes other than by participating as expressly permitted;

 

(b) I grant Sponsor and any Released Entities (as described in Official Rules), the right to use my name, my city of residence, any audio and/or video recordings and any image taken of me on behalf of Sponsor, in connection with the Sweepstakes, in any media now or hereafter devised without limitation and without additional compensation, notification or permission or other liability to me or my heirs, executors, administrators, personal representatives or assignees.    

 

(c) I will accept the prize, as awarded, without further representations or commitments from the Sponsor, and acknowledge that this is a complete RELEASE and DISCHARGE of all claims and rights of the undersigned against the Releasees and that no action will be taken by and on my behalf of the undersigned with respect to any such rights; it is understood that this release shall be binding upon the undersigned and any relations, affiliates and other associated entities of the undersigned.

 

(d) I have been given a full opportunity to review and analyze this Release as well as the Official Rules.  I fully and completely understand all the terms and conditions set forth in this Release and sign it voluntarily, freely, and knowingly.
